1. About 12thGems

12thGems (“we”, “us”, “our”) is an online retailer of gemstone bracelets and astrology-inspired jewelry, shipping to customers in the United States. Questions about these Terms can be sent to 12thgems@gmail.com.

2. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. By ordering you confirm that the information you provide is accurate and that you are authorized to use the payment method supplied.

3. Products and natural variation

Every 12thGems bracelet is made from natural gemstone. Because natural stone is never uniform, the color, banding, translucency and pattern of the beads you receive will differ from the photographs on this site. Such variation is a characteristic of the material, not a defect, and is not grounds for return.

We make every effort to display product colors accurately, but screen calibration and lighting mean we cannot guarantee that your display matches the physical item.

4. Astrology readings are for entertainment

Our birth-chart reading and the bracelet recommendations it produces are provided for entertainment, reflection and personal enjoyment. They are not medical, psychological, financial or legal advice, and they are not a substitute for professional guidance of any kind. Any decision you make based on a reading is your own.

5. Prices, orders and payment

• All prices are shown in U.S. dollars (USD) and exclude applicable sales tax and shipping unless stated otherwise.
• Your order is an offer to buy. A contract is formed only when we send you a shipping confirmation email.
• If a product is listed at an incorrect price or with incorrect information due to a typographical or system error, we may cancel the order and refund you in full, after notifying you.
• We may decline or limit any order, including orders that appear to be placed by dealers or resellers.

6. Shipping, risk and title

We currently ship within the United States. Delivery estimates shown at checkout are estimates only and are not guaranteed. Title and risk of loss pass to you when the order is handed to the carrier. Please see our Shipping Policy page for current delivery windows and costs.

7. Returns and refunds

Unworn items may be returned within 30 days of delivery for a refund of the item price, excluding original shipping, unless the item is faulty or we made an error. Earrings and other pierced items cannot be returned for hygiene reasons once the seal is broken. Full conditions and the return procedure are on our Refund and Returns Policy page.

8. Reviews and user content

You may post reviews and other content on the site. You retain ownership of what you write, and you grant 12thGems a non-exclusive, royalty-free, worldwide licence to display, reproduce and distribute it in connection with the site and our marketing.

When you post, you agree that your content will not be unlawful, defamatory, obscene, harassing or deceptive; will not impersonate anyone; will not infringe another party’s rights; and will not contain malware or spam. We may edit, refuse or remove any content at our discretion, and we may suspend accounts that breach this section.

9. Intellectual property

The 12thGems name and logo, our product photography, the text and layout of this site, and our birth-chart reading output are owned by us or licensed to us and are protected by copyright and trademark law. You may not copy, reproduce, scrape, republish or commercially exploit any part of the site without our written permission.

10. Disclaimer of warranties

The site and its contents are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free.

11. Limitation of liability

To the fullest extent permitted by law, 12thGems will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of your use of the site or any product purchased from it. Where liability cannot be excluded, it is limited to the amount you paid for the order in question.

Nothing in these Terms limits any right you have under applicable consumer protection law that cannot lawfully be limited.

12. Indemnity

You agree to indemnify 12thGems against any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the site.

13. Privacy

How we collect, use and protect your personal information is described in our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. Continued use of the site after a change means you accept the updated Terms.

15. Governing law
